Terms of service

These terms are an agreement between you and Joshua Bemenderfer, an individual in Georgia, USA, who runs CubbyCAD ("we" or "us"). They cover cubbycad.com, the editor, the explore and browse pages, the embeddable part viewer and the slicer (together, "the service"). The privacy policy explains how we handle your data.

Accepting these terms

By using CubbyCAD or making an account, you agree to these terms. If you don't agree, please don't use the service.

Who can use CubbyCAD

You need to be at least 13 years old. If you're under 18, you need permission from a parent or guardian, and they need to agree to these terms too.

Your account

You don't need an account to use the editor. If you make one, you're responsible for what happens under it. Keep your password safe, and email [email protected] if you think someone else has access to your account.

The service

CubbyCAD is provided as it is, and it changes over time. Features may be added, changed or removed. There are free and paid plans. What each plan includes is described on the pricing page and may change.

Paid plans

A paid plan costs the price shown on the pricing page at the time you subscribe. Payments are handled by our payment processor.

Renewal and cancellation

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the billing portal. The cancellation takes effect at the end of the period you've already paid for, and you keep your paid features until then.

Refunds

We don't refund partial billing periods, except where the law requires it. If something went wrong with a charge, email [email protected] and we'll sort it out.

Price changes

We'll give you notice before a price change applies to your subscription, so you can cancel first if you don't want to keep it.

You own it

The parts, scenes, files and anything else you make or upload stay yours. We don't claim ownership of any of it.

What you let us do with it

You give us a limited permission to store, process and display your content, only as needed to provide the service to you. If you make a workspace or part public, you also give us permission to show it publicly, on the explore and browse pages and in embeds. This permission ends when you delete the content or make it private again, apart from backup copies, which roll off on their own.

Public parts

Anyone can view a public workspace or part, and anyone can embed it on another website. Keep a part private if you don't want that.

Acceptable use

You may not store or share any of the following on our cloud servers:

• anything illegal
• sexually explicit or pornographic material
• any content that sexualises minors (we report this to the authorities)
• content that infringes someone else's copyright, trademark or other intellectual property
• malware or other harmful code
• content that harasses people or promotes hate against them
• designs for weapons or weapon parts that are illegal to make or own where you are

You also may not:

• send spam or use the service to abuse other people
• try to break into, probe or get around the security of the service or of other people's accounts
• use scripts, bots or other automated tools in a way that puts excessive load on the service

Enforcement

If content or an account breaks these rules, we may remove the content and suspend or close the account, with or without notice.

Copyright and IP complaints

If you think something on CubbyCAD infringes your copyright or other intellectual property, email [email protected] with a link to it, what you think it infringes, and how to reach you. We'll look into it and take it down if it does.

Third-party services

Payments go through our payment processor, and third-party services you connect, like sign-in or AI providers, have their own terms. We aren't responsible for their services.

No warranty

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the service will always be available, free of errors, or that it will never lose data, so keep your own copies of anything important.

Printed parts

CubbyCAD makes no guarantee that a model, or anything made from it, is accurate, strong enough, safe or fit for any purpose. What you print or manufacture, and how you use it, is your responsibility. Check dimensions and test parts before you rely on them, especially anything that carries a load or could hurt someone if it fails.

Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim, or $50.

Indemnity

If someone makes a claim against us because of your content or because you broke these terms, you agree to cover the resulting damages and our reasonable costs, including legal fees.

Ending things

You can stop using CubbyCAD at any time, and you can ask us to delete your account by emailing [email protected]. We can suspend or close accounts that break these terms, as described above. If we decide to shut down the service, we'll give you reasonable notice and a chance to export your cloud files first. The sections on your content, warranties, liability and indemnity still apply after your account ends.

Governing law

These terms are governed by the laws of the State of Georgia, USA.

Changes to these terms

We may update these terms. When we do, we'll change the date at the top, and for material changes we'll tell you by email or with a notice on the site. If you keep using CubbyCAD after a change takes effect, you agree to the new terms.
